1. Introduction
Welcome to EquinoxResource ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website at equinoxresource.sbs (the "Service") provided by EquinoxResource.
Your agreement to these Terms is required for booking a charter or utilizing our Service. Should you disagree with any portion of the terms, access to the Service is not permitted.
2. Service Overview
The yacht charter services offered by EquinoxResource encompass:
- Rental of yachts on a daily basis
- Evening boat rides
- Business getaway events
- Exclusive event hosting
- Extended charter trips
Our services are dependent on availability and weather conditions and may be changed or withdrawn at our discretion.
3. Booking and Reservations
3.1 Booking Process
Charter booking requirements include:
- Minimum age of 18
- Provision of truthful and complete details
- Payment of a deposit as noted in your booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
Confirmation of your booking is upon our receipt of payment and a confirmation document from us. We hold the authority to decline service to anyone at our discretion.
3.3 Availability
Availability for charters is contingent on the vessel and appropriate weather conditions. Efforts will be made to accommodate preferred schedules for bookings.
4. Payment Terms
4.1 Pricing
All our fees are quoted in € and incorporate all relevant taxes unless stated otherwise. Prices may be subject to change without prior notice.
4.2 Payment Schedule
- A deposit of 50% of the total cost is due at the time of booking
- Full payment is due 48 hours before the departure of the charter
- Any supplementary charges are payable at the end of the charter
4.3 Payment Methods
We accept the majority of credit cards, direct bank transactions, and certified cheques. Payments are processed through secure and encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Full refund minus processing fees for cancellations more than 72 hours prior to departure
- A refund of 50% for cancellations between 24 to 72 hours before departure
- No refund if the cancellation occurs less than 24 hours before departure
5.2 Weather Cancellations
We will propose to either:
- Reschedule to an alternative date at no added cost in case of unsafe weather conditions, as determined by our captain
- Offer a full refund when rescheduling is not an option
5.3 Mechanical Issues
If the assigned vessel encounters mechanical issues, we'll attempt to provide an appropriate substitute. If that's not possible, a complete refund will be given.
6. Safety and Conduct
6.1 Safety Requirements
All guests are obliged to:
- Adhere to all directives from the crew
- Don safety gear as and when required
- Inform of any health conditions that may influence their safety
- Stay within designated parts of the vessel
6.2 Prohibited Items
Certain items are not permitted on board:
- Containers made of glass
- Illicit substances
- Weapons or firearms
- Excessive quantities of beverages
- Pets (special exceptions may be made upon prior approval)
6.3 Conduct
Passengers are expected to maintain respectful behavior. Charters can be canceled without a refund if passengers' actions present a safety concern or cause disruption.
7. Liability and Insurance
7.1 Our Liability
Our liability shall be confined to the amount paid for your charter. We are not liable for:
- Injuries caused by the negligence of passengers
- The loss or destruction of personal belongings
- Indirect or punitive damages, or any consequential loss
- Delays due to weather or factors outside our control
7.2 Insurance Coverage
Our vessels and operations are insured through a comprehensive marine insurance policy. It is the passengers' responsibility to secure their travel and personal insurance.
7.3 Assumption of Risk
Engaging in our offerings implies accepting the inherent risks of maritime activities and assuming liability for personal safety.
8. Modifications and Itinerary Changes
We reserve the right to alter itineraries, paths, or schedules due to weather, safety, or operational demands. Efforts will be made to ensure equivalent experiences are provided.
9. Force Majeure
Delays, cancellations, or changes due to forces beyond our control are not our responsibility. These could include:
- Extreme weather conditions
- Natural disasters
- Governmental decrees
- Shutdowns of ports
- Equipment failures
10. Privacy and Data Protection
Your data is managed following our Privacy Policy. By engaging with our services, you consent to the processing of your information as outlined in the Privacy Policy.
11. Intellectual Property
Our website's content, like text, visuals, logos, and images, is owned by us and shielded under copyright and trademark statutes. Reproduction, distribution, or creating derived products without our explicit consent is prohibited.
12. Governing Law
These Terms are regulated by the laws in force in Germany. Disputes will be settled in the courts located in Hamburg, Germany.
13. Changes to Terms
We may modify these Terms as necessary. New versions will be displayed on our website along with the revision date. Using our services after such changes implies acceptance of the new Terms.
